The state of Kelantan, Terengganu, Johor, Perlis and Kedah have their own similar Waters Enactments. The power to issue licenses for certain purposes is with the State Authority. (water abstraction, diversion, etc.). Section 2 : Definition of rivers. Gazetting. Section 3 : Entire property in and control of all rivers in any State is vested solely with the Ruler of such state. Section 4 : Restoration of river banks. Section 5 : Prohibits acts affecting river such as felling of any tree in to the river, obstruct or interfere with any river, build any bridge, jetty or landing stage over or beside any river (width > 20 feet) except under a license. Section 8 : License needed to divert water which may authorize interference with state or alienated land. Section 14 : Restriction on construction of walls and buildings on river banks (50 ft.) or within flood channels. For SARAWAK, Sarawak Land Code (Cap 8) : State has sole property in rivers, streams, lakes and water courses. Sarawak Riverine Transport Bill (1993) also addresses on rivers in Sarawak and management of them. |
